The labelling re-quirements of Regulation (EC) No 1272/2008 constitute the basis for the labelling requirements of Directive 75/324/EEC with regard to “non-flammable”, “flammable” and “extre-mely flammable” aerosol dispensers. The intended modi-fications do not have any competitiveness or other impact as they do not affect the content of the requirements as those were already updated with Commission Directive 2013/10/EU of 19 March 2013 amending Directive 75/324/ EEC in order to adapt its labelling provisions to Regulation (EC) No 1272/2008. The provisions of Directive 2013/10/EU also reflect the, at the time, on-going modification of the CLP Regulation which led to the subsequent adoption of Commission Regulation (EU) No 487/2013. However, the adoption of the latter Regulation enables a further simpli-fication of the labelling provisions of Directive 75/324/EEC by less and more comprehensive legal references. The su-ggested adaptation will therefore also reduce the need for future modifications of the labelling provisions of Directive 75/324/EEC due to further updates of the corresponding provisions of Regulation (EC) No 1272/2008. Objeto y razón de ser: The draft Commission Directive in-tends to increase the maximum allowable pressure of an aerosol dispenser in case of use of non-flammable pro-pellants and also to align the labelling provisions of Di-rective 75/324/EEC to the latest relevant modifications of Regulation (EC) No 1272/2008 by Commission Regulation (EU) No 487/2013. The draft Directive will provide aerosol dispenser manufac-turers with an additional and therefore a wider choice in the case of use of non-flammable propellants, without affecting the current levels of safety provided for by Directive 75/324/ EEC. It will also increase coherence and legal clarity between the labelling provisions of Directive 75/324/EEC and the labe-lling provisions of Regulation (EC) No 1272/2008. As the draft measure does not provide for any new obliga-tions for manufacturers but rather for an additional option and, in the absence of any substantial change to the labelling requirements of Directive 75/324/EEC as modified by Directi-ve 2013/10/EU, it will not result in any risk of barrier to trade. On the contrary, it will further facilitate international trade as it results in less strict requirements as far as the maximum allowable pressure limits are concerned. Notificación: G/TBT/N/EU/340 Draft Commission Regulation amending Regulation (EU) No 432/2012 establishing a list of permitted health claims made on foods other than those referring to the reduction of disea-se risk and to children’s development and health (5 pages + 9 pages of annex, in English). This draft Commission Regulation concerns the amendment of the list of authorised health claims made on foods other than those referring to the reduction of disease risk and to children’s development and health in accordance with Arti-cle 13(4) of Regulation (EC) No 1924/2006 of the European Parliament and of the Council of 20 December 2006 on nu-trition and health claims made on foods. Objeto y razón de ser: The proposed measure concerns amend-ments to be introduced in the conditions of use of two health claims on meal replacement for weight control as a conse-quence of the repeal, by Regulation (EC) 609/2013, of Directi-ve 96/8/EC of 26 February 1996 on foods intended for use in energy-restricted diets for weight reduction. The assessment of the European Food Safety Authority was favourable. The-refore this health claims comply with the conditions set out in Regulation (EC) No 1924/2006, and will be authorised for use on foods. Protection of human health or safety. Notificación: G/TBT/N/EU/341 Draft Commission Implementing Regulation concerning the non-renewal of approval of the active substance isoproturon, in accordance with Regulation (EC) No 1107/2009 of the Eu-ropean Parliament and of the Council concerning the placing of plant protection products on the market, and amending Implementing Regulation (EU) No 540/2011 (4 pages, in English). This draft Commission Implementing Regulation provides that the approval of the active substance isoproturon is not renewed in accordance with Regulation (EC) No 1107/2009. Existing authorised plant protection products containing isoproturon will be withdrawn from the market. The non-approval is based on the first evaluation of the substance for use as a pesticide active substance in the EU under Regula-tion (EC) No 1107/2009. The substance was formerly appro-ved under Directive 91/414/ EEC. This decision only concerns the placing on the market of this substance and does not affect the Maximum Residue Levels (MRLs) for residues of the concerned pesticide. However, fo-llowing non-approval, separate action will be taken to lower MRLs to the limit of quantification (LOQ). In order for an active substance to be approved in accor-dance with Regulation (EC) No 1107/2009 (concerning the placing of plant protection products on the market), it must be demonstrated that the substance is not harmful to human health, animal health or the environment. Criteria are listed in Article 4 of the Regulation (and also detailed in Annex II) which must be met to enable approval. During the evaluation and peer-review of the substance, a number of concerns and areas that could not be finalised were identified. These are detailed in the conclusion of the European Food Safety Authority (EFSA); importantly, the EFSA concluded that there is a high potential for the repre-sentative uses assessed to result in groundwater exposure above the drinking water limit of 0.1 μg/L by the relevant metabolites of isoproturon in situations represented by all pertinent groundwater scenarios. In addition, a high long term risk to birds, wild mammals and aquatic organisms was also identified. These concerns mean that isoproturon does not meet the ap-proval criteria as outlined in Regulation (EC) No 1107/2009 and cannot be approved currently. Existing authorisations will need to be withdrawn; Member States must withdraw existing plant protection products containing isoproturon at the latest by 3 months from the date of entry into force. A period of grace in line with Article 46 of Regulation 1107/2009 is allowed for and shall expire at the latest on 30 November 2016 (allowing for a final season of use).
